 | Glenn Wheatley jailed |  |
 | Music entrepreneur Glenn Wheatley has been sent to jail for more than a year for tax evasion.
In the Victorian County Court, a stunned and visibly pale Wheatley agreed to the judge's offer of a discounted sentence allowing him to serve at least 15 months in jail instead of two-and-a-half years.
Wheatley, 59 of South Yarra, pleaded guilty earlier this month to three charges relating to not declaring income from a John Farnham tour and a Kostya Tszyu boxing match.
He was charged after an Australian Crime Commission (ACC) investigation, Operation Wickenby, into a Swiss-based tax minimisation scheme. The Operation is believed to be the biggest white collar criminal investigation in Australia's history.
"I'm ashamed of what I have done," Wheatley told the court last month.
"It was something that I have regretted for a long, long time and I'm ashamed of what I've brought on my family, who have had to suffer a lot."
Today Wheatley appeared stunned that his guilty plea and cooperation with the ACC had not spared him jail. In 2005, the Director of Public Prosecutions (DPP) promised to support a suspended sentence. The DPP reneged a month later.
Judge Wood praised Wheatley for his cooperation with authorities regardless.
But Judge Wood said all taxpayers were the victims of Wheatley's offending, and his offences had placed an unfair burden on honest citizens.
He also said a message of deterrence had to be sent to the community.
Earlier this week, Wheatley repaid the tax amount of $318,000.
He also indicated his intention to help authorities with their continuing investigation.
Judge Wood said he hoped Wheatley could provide valuable information about the promoters of the offshore scheme.
